LevelUp + Sprint Billing Terms of Service
SCVNGR, Inc., doing business as LevelUp ("LevelUp") has partnered with Sprint Corporation ("Sprint") to permit Sprint customers to use LevelUp technology and platforms to make authorized purchases that the customer can elect to bill to their Sprint mobile telephone bill. These Billing Terms of Service, in addition to LevelUp's User Terms and the terms of your agreement with Sprint, govern your use of the LevelUp apps and service in connection with your Sprint account, and explain the manner in which you authorize charges to your Sprint bill. THESE TERMS CREATE A BINDING LEGAL AGREEMENT BETWEEN YOU, LEVELUP, and SPRINT. PLEASE READ THEM CAREFULLY.
LevelUp and Sprint may from time to time amend, update, or change these Billing Terms, by posting the amended terms on the LevelUp website. You are under a continuing obligation to review the current version of these Billing Terms and other published LevelUp policies. In the event of an amendment to these Billing Terms, You agree that your continued use of your LevelUp User Account in connection with your Sprint carrier account shall constitute your agreement to the Billing Terms as so amended. If you do not agree to the amended Billing Terms, you must disable your Sprint carrier account as a payment source within your LevelUp User Account in accordance with the terms below.
1. Authorization of Charges to Your Sprint Carrier Account
By clicking the "Pay with Sprint" button in a LevelUp app or on the LevelUp website, and by providing your Sprint credentials (including your Sprint telephone number) to register your Sprint account with LevelUp as a payment source, you expressly authorize LevelUp to charge your Sprint carrier account for all charges that you incur in accordance with LevelUp's User Terms, and you agree to pay Sprint for such charges in accordance with Sprint's billing and collection procedures and your agreement with Sprint. You represent that you are the account holder of the Sprint carrier account provided to LevelUp and are fully authorized to incur charges billed to your Sprint account.
You may authorize individual charges to your Sprint carrier account in the following ways using the LevelUp service:
You authorize LevelUp to charge to your Sprint carrier account by presenting your LevelUp QR code at checkout in connection with a transaction at a LevelUp merchant. In order to present your LevelUp QR code, you must launch the LevelUp app on your mobile device and physically present the displayed QR code in view of the LevelUp scanner at the merchant's point-of-sale terminal. The scanner will illuminate to indicate a successful scan. By opening the LevelUp app and presenting your QR code to a LevelUp scanner at the point-of-sale, you authorize LevelUp to charge your Sprint account for the amount of the transaction.
You may also use your LevelUp account to make purchases, and thereby authorize charges to your Sprint carrier account, online via certain websites and/or mobile applications by logging in to the website or application using your LevelUp credentials (the email address registered with your LevelUp account in combination with the password you created for your LevelUp account).
Upon login to an app powered by LevelUp using your LevelUp credentials, you may be enabled to place online orders within the app. By clicking the "place order" or "checkout" button within a LevelUp-powered app, after logging in with your LevelUp credentials, you authorize LevelUp to charge your Sprint account for the amount of the transaction.
Non-LevelUp Apps and Websites
LevelUp enables you to make purchase from certain websites and mobile apps not powered by LevelUp by entering your LevelUp credentials into the app or website as a payment method during the checkout process. Upon entering your LevelUp credentials to authorize payment, a notification will be sent to a LevelUp app on your mobile phone requesting your permission to charge your LevelUp account for the transaction. By clicking the "Accept" or "I Agree" button presented, you authorize LevelUp to charge your Sprint carrier account for the amount of the transaction.
LevelUp App PIN Lock
Each LevelUp app used by you to authorize individual charges by scanning your QR code at a physical point-of-sale includes an optional PIN-lock feature that allows you to lock the app from unauthorized access. LevelUp and Sprint strongly recommend that you enable the PIN-lock feature and set a secure PIN code not disclosed to any other person. You agree that your entry of your PIN-lock code within a LevelUp App, or alternatively your refusal to set a PIN-lock in the app, represent a further authorization to LevelUp to make charges to your Sprint carrier account. LevelUp and Sprint also recommend that you employ the PIN-lock feature on your mobile device as a further security measure.
After each charge that you authorize LevelUp to charge to your Sprint carrier account, you will receive an electronic receipt from LevelUp including an email to the email address registered with your LevelUp account and an in-app electronic receipt within your LevelUp app. Other notifications of these charges also may be provided. Each of these receipts will provide confirmation information about the authorized LevelUp charge billed to your Sprint account for the amount of the transaction. If you receive a receipt for a transaction that you believe was not authorized by you, or in an amount that was incorrect, contact LevelUp within 3 business days either using the in-app notification feature, by email to email@example.com, or by phone to 1-855-538-3542.
Refunds and Returns; Account Credits
In the event you are entitled to a reversal or refund of any LevelUp transaction authorized by you to be charged to your Sprint carrier account, or other adjustment associated with a purchase you made using your LevelUp account and your Sprint carrier account, you also authorize LevelUp to make a credit to your Sprint carrier account to accomplish that transaction.
Revoking Your Authorization to LevelUp
You may revoke the authorization granted to LevelUp to charge your Sprint carrier account at any time by logging in to the LevelUp App or Website (https://www.thelevelup.com/) and disabling your Sprint carrier account as an authorized payment source. If you have any questions about disabling the connection or authorization, you may contact LevelUp Support through the in-app notification eature, by email to firstname.lastname@example.org, or by phone to 1-855-538-3542. You agree that all individual point-of-sale or online charges authorized by you in accordance with these terms prior to such deactivation will still be made to your Sprint carrier account.
If you do not agree to these Terms, and the authorization procedures set forth above, you should revoke and/or disable the connection between your LevelUp account and your Sprint account immediately.
2. No Fees
Neither LevelUp nor Sprint charges any fees to Users in connection with LevelUp transactions authorized to be charged to your Sprint carrier account. To the extent you fail to pay your Sprint bill in accordance with your agreement with Sprint, additional fees and charges may apply.
3. Transaction Limits
LevelUp and Sprint each reserves the right to limit the number, amount, and aggregate amount of transactions that may be made using LevelUp and authorized to be charged to your Sprint carrier account. In the event a LevelUp transaction is denied by Sprint, you will be required to provide an alternative form of payment to LevelUp (such as a valid, U.S.-issued debit card), in accordance with LevelUp's User Terms, in order to complete the transaction. If you have already linked a secondary payment source in addition to your Sprint carrier account, you authorize LevelUp to charge that secondary account in the event of a failed Sprint transaction in accordance with LevelUp's User Terms.
4. Your Sprint Statements
LevelUp charges to your authorized Sprint carrier account may appear on your statement from the card issuing institution as "LEVELUP*" followed by an identifier related to the LevelUp merchant partner at which the transaction occurred. You agree not to knowingly falsely report such charges as fraudulent or unauthorized claims to your payment instrument issuing institution. A knowingly false report of a fraudulent or unauthorized charge shall be grounds for LevelUp, in its discretion, to cancel your User Account, and seek any other remedies available to LevelUp.
5. Disputed Charges
If LevelUp confirms that a transaction(s) charged to your Sprint carrier account by LevelUp and reported by you as unauthorized was an unauthorized or fraudulent use of your LevelUp User Account, and if: (i) the first such unauthorized transaction was reported to LevelUp within two (2) business days of a transaction receipt; or (ii) in the case of a lost device, the lost device was reported within two (2) business days of the loss; LevelUp will reimburse you for the amount of any fraudulent or unauthorized transactions charged to your payment instrument.
If you fail to notify LevelUp of a fraudulent or unauthorized transaction using your LevelUp User Account within three (3) business days of a transaction receipt, or in the case of a lost device, within two (2) business days of the lost device, you will be responsible for the fraudulent or unauthorized charges in an amount limited to the lesser of: (i) $500; OR (ii) the sum of either $50 or the amount of the fraudulent use during the initial two (2) days (whichever is less), AND the sum of all fraudulent or unauthorized activity after the initial three (3) days prior to your notification to LevelUp. You authorize LevelUp to submit to your Sprint carrier account such charges up to that limited amount.
If you fail to notify LevelUp of a fraudulent or unauthorized transaction using your LevelUp User Account within sixty (60) business days of a transaction receipt, or in the case of a lost device, within sixty (60) business days of the lost device, you will be responsible for all fraudulent or unauthorized charges after the sixty (60) day period, and authorize LevelUp to submit such charges to your Sprint carrier account.
In the event that the state in which you established your LevelUp User Account provides for lower limitations on liability for fraudulent use, such limitation shall apply in place of these provisions.
6. Protecting Your LevelUp Credentials and QR Code
It is your responsibility to protect your QR code from unauthorized use or access, including by setting the available PIN-lock within your phone and within your LevelUp app, preventing unauthorized persons from gaining access to your phone or to your LevelUp account credentials, and by preventing unauthorized persons from obtaining an image or copy of your QR code. If you believe that your phone, LevelUp app, LevelUp credentials, or QR code have been compromised, you may reset your QR code within a LevelUp app or online, or should contact LevelUp Support immediately through the in-app notification feature, by email to email@example.com, or by phone to 1-855-538-3542.
7. Prohibited Transactions
The LevelUp service may be used only for the bona fide purchase and exchange of goods and/or services offered in the ordinary course of a merchant's business, and may not be used to process a payment or otherwise transfer money between two parties that is unrelated to a purchase of a product or services. In addition to these restrictions, you are not permitted to use your LevelUp account for any of the following types of transactions:
- The LevelUp service may not be used for transactions in which you request cash back from the merchant.
- The LevelUp service may not be used for transactions with merchants located outside the United States.
- The LevelUp service may not be used for transactions that are illegal.
LevelUp reserves the right to decline any attempted transaction if it appears that any of these Billing Terms of Service or LevelUp's User Terms have been violated.
8. Termination, Suspension, or Modification of Services
You may terminate this Agreement at any time by disabling your Sprint carrier account as a payment source within your LevelUp User Account in accordance with the terms above.
Each of LevelUp and Sprint reserves the right to suspend or terminate your LevelUp User Account, your Sprint carrier account, and/or your ability to have LevelUp make charges to your Sprint carrier account, at any time, without notice to you, if LevelUp or Sprint believes you are in breach of this Agreement, or if it believes that you are using the LevelUp Services or any LevelUp App in a manner harmful to LevelUp, its merchants, users, or any other third party. Any such termination, suspension, or modification will terminate any reward credit that you may otherwise be or have been entitled to.
LevelUp reserves the right to modify the LevelUp services and LevelUp apps, any features or aspects of the services or apps, including the manner in which charges to your Sprint carrier account are authorized or made using the LevelUp service, at any time, without notice to you.
